Terms of Service for Knowledge Gap Guide

1. Acceptance of Terms

By accessing or using Knowledge Gap Guide (“Service”) provided by Axelby LLC, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Changes to Terms

We may modify these Terms at any time. We will post updates at/terms and indicate the effective date. Continued use after changes indicates acceptance.

3. Eligibility

You must be at least 18 years old and reside in the United States or Canada. By registering, you represent and warrant that you meet these criteria.

4. Account Registration

• You may register using your email/password or via Google/Facebook authentication.
• You are responsible for maintaining the confidentiality of your credentials and all activities on your account.

5. License and Use

We grant you a non-exclusive, non-transferable, revocable right to use the Service strictly in accordance with these Terms. You acquire no other rights or licenses.

6. Prohibited Conduct

You agree not to:

• Reverse engineer, decompile, or disassemble the Service.
• Use the Service to violate any law or third-party rights.
• Introduce malicious code or disrupt the Service.

7. Subscription Plans & Course Purchases

• Subscriptions: Monthly fee paid by credit card via Stripe; automatically renews.
• Course Purchases: One-time, permanent access to specific course content.
• Cancellation: Cancel anytime; access continues until end of current billing cycle.
• Non-Payment: Account suspended immediately until payment is made.
• No refunds except as required by law or at our sole discretion.

8. Intellectual Property

All content, features, and functionality of the Service are owned by Axelby LLC or its licensors. You may not copy, modify, distribute, or create derivative works without our express written consent.

9. User-Generated Content

You retain ownership of any feedback or responses (“User Content”) you submit, but grant us a worldwide, perpetual, royalty-free license to use, reproduce, modify, and display it in connection with the Service.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AXELBY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE FEES YOU PAID IN THE SIX MONTHS PRIOR TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Axelby LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your breach of these Terms or violation of any law or third-party rights.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, U.S.A., without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the state and federal courts in Travis County, Texas.
